Terms of Service for Use of Custom Images

1. Description. Rugs Direct customers can upload images for printing on rugs (the “Services”).
2. Restrictions.
   1. You may not use images that would violate the rights of others. Unless you are Elvis Presley you may not upload an image of Elvis to be printed on your rug. The same is true for sports teams, music groups, other celebrities, colleges, universities and other trademark owners (e.g. the Nike swoosh or the Coca-Cola symbol).
   2. You may not use images that violate someone else’s copyright rights. You may only use artwork or other images containing someone else’s copyright protected work if you have their written consent.
   3. You may not use images Rugs Direct deems in its sole discretion are offensive or inappropriate. Examples of offensive or inappropriate images are those that are obscene, vulgar, pornographic, hateful, racist, or that incite or celebrate violence or any other illegal activity.
   4. Rugs Direct shall, in its sole and exclusive discretion, determine whether images are permitted under this policy and reserves the right to refuse to print any image. If you place an order for an item declined by Rugs Direct your purchase price will be refunded.
3. Licensing Your Images to Rugs Direct. You shall retain copyright ownership of the images submitted. You hereby grant to Rugs Direct a royalty-free, worldwide, transferable, nonexclusive, right and license to use such images, in all media existing now or created in the future, as Rugs Direct deems necessary to enable you to use the Services. Rugs Direct may sublicense the rights that you grant it in this Section to a third party subcontractor only for purposes of processing your order, and producing and shipping your products.
4. Representations and Warranties. You represent and warrant to Rugs Direct that:
   1. You will not infringe the copyright, trademark, patent, trade secret, right of privacy, right of publicity or other right of any third party;
   2. You will not violate any applicable laws, rules, and regulations;
   3. You are the owner of the images and/or have the proper authority and permissions to use the images in connection with the Services, including written consents from any person identifiable in the images (or that person’s guardian if the person in the image is under 18);
   4. There are no claims, demands or litigation pending, or to the best of your knowledge, threatened with respect to the use of any of your images; and
   5. Rugs Direct will not be required to make any payments to any third party in connection with your images, except for the expenses that Rugs Direct incurs in providing the Services.
5. Indemnification. You agree to defend, indemnify and hold harmless Rugs Direct and its employees, representatives, agents, affiliates, directors, officers, managers, shareholders, successors and assigns from any damage, loss, or expense (including without limitation, attorneys' fees and costs) incurred in connection with any third-party claim, demand or action alleging a breach of any duty owed under this agreement.
6. Cancellations and Returns. Custom-made rugs cannot be canceled once the production process has begun and are not returnable unless there is damage or a defect. In this case we will gladly provide you a replacement for the custom-made item(s).

  • For a 1'8" x 2'8" rug - 400 x 640 pixels
  • For a 2'7" x 4'1" rug - 620 x 980 pixels
  • For a 3'11" x 4'7" rug - 940 x 1100 pixels
  • For a 5' x 7' rug - 1200 x 1680 pixels
